At Uterkit S.A.S. (hereinafter 'Uterkit', 'we', or 'the Platform'), with registered address at Av. República del Salvador N34-127, Quito, Ecuador, and Tax ID (RUC) 1792847561001, we are committed to protecting the privacy and personal data of our users in accordance with Ecuador's Organic Law on Personal Data Protection (LOPDP), effective since 2023.
1. Data controller
The data controller is Uterkit S.A.S., registered at the Quito Commercial Registry under public deed No. 2021-0847, with registered address at Av. República del Salvador N34-127 y Suiza, Edificio Prisma Norte, Floor 8, Office 802, Quito, Pichincha, Ecuador. You may contact our Data Protection Officer at privacidad@uterkit.com.
2. Data we collect
We collect the following personal data: (a) Identification data: full name, ID or passport number, home address; (b) Contact data: email address, phone number; (c) Financial data: banking information for transactions, investment history on the platform; (d) Browsing data: IP address, browser type, pages visited, time spent; (e) Data voluntarily provided through contact forms.
3. Purpose of processing
We process your data to: manage your account and verify your identity under anti-money laundering regulations (UAFE); process and administer your investments in crowdlending projects; send you transactional communications and performance reports; comply with legal and regulatory obligations before Ecuador's Superintendency of Companies; improve our services through aggregated usage analysis; respond to your inquiries submitted through the contact form.
4. Legal basis for processing
Data processing is based on: your explicit consent upon registration; execution of the investment contractual relationship; compliance with legal obligations (Securities Market Law, SCVS regulations, LOPDP); our legitimate interest in preventing fraud and improving the platform.
5. Your rights
Under Ecuador's LOPDP, you have the right to: access your personal data at any time; rectify inaccurate or incomplete data; request deletion of your data when no longer necessary; object to processing for direct marketing purposes; request data portability in a structured format; file a complaint with Ecuador's Personal Data Protection Authority. To exercise these rights, write to privacidad@uterkit.com with your request and a copy of your identification.
6. Data retention
We retain your personal data for the duration of the contractual relationship and, subsequently, for the periods required by Ecuadorian law (minimum 7 years for financial records as per SRI regulations). Browsing data is retained for a maximum of 13 months.
7. International transfers
Your data may be transferred to technology service providers located outside Ecuador (hosting and analytics services). These transfers are made with adequate safeguards in accordance with Article 42 of the LOPDP, through standard contractual clauses approved by the competent authority.
8. Security
We implement technical and organizational measures to protect your data: TLS 1.3 encryption on all communications; encrypted storage of sensitive data; role-based access controls; quarterly security audits; incident response plan in compliance with the LOPDP.
